BIG BROTHER IS
WATCHING...YOUTUBE? In yet another unsettling sign that George
Orwell just may have been the most prophetic man of the 20th
Century, last week federal judge Louis Stanton handed down a ruling
requiring Google to make available to media conglomerate Viacom
intimate details of YouTube users' viewing habits, including user
names, IP addresses and lists of every video a user has ever watched.
The ruling came as part of a $1 billion copyright infringement
lawsuit brought against YouTube and its corporate parent, Google, by
Viacom. Curiously, the lawsuit wasn't filed until after the
deep-pocketed Google had acquired YouTube from its-then relatively
poor founders. Viacom stated that it needed the information to
demonstrate that its copyrighted material, ranging from "South
Park" to "The Daily Show" and "Colbert Report," was
routinely posted and viewed by YouTube users.
The ruling provoked an
immediate outcry from a host of privacy advocates, with the
Electronic Frontier Foundation (EFF) pointing out that Judge
Stanton's ruling seemingly overlooks the federal Video Privacy
Protection Act (VPPA), which was passed after a newspaper printed a
list of then-Supreme Court nominee Robert Bork's video rental
records. The EFF concluded, "The Court's erroneous ruling is a
set-back to privacy rights, and will allow Viacom to see what you are
watching on YouTube. We urge Viacom to back off this overbroad
request and Google to take all steps necessary to challenge this
order and protect the rights of its users."
For its part, Viacom
said it has no plans to use the information to file lawsuits against
YouTube users, a la the RIAA and file-sharers. In a statement,
the conglomerate said that it had never asked for any personal
identity data: "Any information that we or our outside advisors
obtain--which will not include personally identifiable
information--will be used exclusively for the purpose of proving our
case against YouTube and Google, will be handled subject to a court
protective order and in a highly confidential manner." Meanwhile,
Google has asked for time to "anonymize" the logs before
producing them pursuant to the court order, a request that Viacom was
still considering at press time.
VIVA LA VIDA...OR,
STEVE JOBS AND ALL HIS FRIENDS: Amidst all the glad-handing and
back-slapping following the consecutive blockbuster sales weeks
enjoyed by Lil' Wayne and Coldplay, a very significant statistic
fell by the wayside, noticed by but a few. To wit: in a mere two
weeks time, Coldplay's Viva La Vida or Death and All His Friends
has become the best-selling digitally downloaded album in history,
racking up digital-only sales of 354,000 over 14 days. This eclipses
previous record holder John Mayer, whose Continuum has sold
353,000 digital downloads in the almost two years since its September
2006 release. The rest of the Top 5 includes troubled diva Amy
Winehouse's Back to Black at No.3 (with digital sales of
329,000), Daughtry's eponymous debut (323,000) at No.4 and Justin
Timberlake rounding things out with FutureSex/LoveSounds
(302,000).
In similar news, this
week also witnessed Flo Rida's "Low" (featuring T-Pain) become
the first digital track to reach sales of four million paid
downloads. It continues a trend that's been growing exponentially:
Black Eyed Peas were the first act to hit 500,000 paid downloads with
"Let's Get It Started" back in February 2005 and it took
another 10 months for the first song to attain the million-download
mark (Gwen Stefani's "Hollaback Girl"), followed by another 14
months before the two-million milestone was passed (Daniel Powter's
"Bad Day" in December 2006). Souljah Boy Tell 'Em was the first
to reach the three-million mark, with "Crank That Souljah Boy" in
January of this year; now, less than half a year later, the
four-million mark has also been conquered. Look for the five-million
mark to disappear sometime this holiday season.

"NOISE" LOVERS:
One can only imagine how many times the DJs that make up the
Mediaguide Alternative Specialty Song panel heard the frenzied
parental cry, "Turn down that noise!"; this makes it particularly
fitting that the comeback song from '90s Alt faves The Verve, "Love
is Noise," ascends to the top spot of the Song chart this week.
Concurrently, the full album, Four (On Our Own), leaps 13-3 on
the Album end. Richard Ashcroft, Nick McCabe and company are doing
the European festival circuit this summer, but there's still no
word of any North American touring plans, alas. Top debut honors this
week go to Omaha's The Faint, who bow at No.2 with "The Geeks
Were Right," the first cut from their forthcoming album,
Fasciinatiion (Blank.wav), which is hitting stores and
cyberspace August 5 and clocks in at No.5 on the Album index. The
Nebraskan quintet will be starting a month-long tour in support of
the new album in Davenport, Iowa on July 27, followed by a two-week
European jaunt; full details can be found at www.thefaint.com.
The only other track to debut in the Top 10 on the Song chart this
week is "Two Ways Out," which secures a position of No.6 for
California quintet Darker My Love, helping their forthcoming
full-length 2 (Dangerbird, also due August 5) gain the No.10
slot on the Album index. The act which has held the top slot on the
Song side for the previous two weeks, The Hold Steady, drops to No.7
this week with "Sequestered in Memphis"...but can take solace in
the fact that their full-length, Stay Positive (Vagrant),
repeats the No.1 feat and tops the Album chart, dropping Coldplay's
Viva La Vida or Death and All His Friends (Capitol) down to
No.2.
